Terms of Service

Please read these terms carefully before using our services or participating in our programs. These terms supplement our Statuto and Codice di Condotta.

Agreement to Terms

These Terms of Service ("Terms") govern your use of A.S.D. Majorettes Onda Azzurra's services, facilities, and programs. Our association is established pursuant to D.Lgs. 36/2021 (Sports Reform) and is affiliated with CONI and the Italian Twirling Federation (FITw). By becoming a member, you agree to be bound by these Terms, our Statuto, and our Codice di Condotta.

If you do not agree to these Terms, you may not use our services or participate in our programs. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. The complete Statuto is available in our Transparency section.

Important: By submitting a membership application (Art. 5 of Statuto), you accept these Terms, our Statuto, our Codice di Condotta, and the regulations of FITw, CONI and C.I.P.

Membership and Registration (Art. 5 Statuto)
  • Membership is open to individuals of irreproachable moral, civil, and sporting conduct (Art. 5.1-5.2 Statuto)
  • Applications must be submitted in writing via email with accurate information; submission implies acceptance of rules and Statuto (Art. 5.4)
  • Admission is decided by the Board of Directors and communicated via email (Art. 5.5); non-admission can be appealed to the Assembly within 20 days (Art. 5.6)
  • Membership fees are personal, non-transferable, non-refundable, and not revalued (Art. 5.9 Statuto)
  • For minors: applications must be countersigned by parents/guardians who exercise voting rights on their behalf (Art. 5.10)
Code of Conduct (Codice di Condotta)
  • All members must comply with our official Codice di Condotta document, available in the Transparency section
  • Discrimination, harassment, bullying, and any form of abuse (physical, emotional, psychological) will not be tolerated
  • Members must follow all safety guidelines and instructions from coaches, the Safeguarding Officer, and staff
  • Sanctions range from verbal warning to written warning, suspension, or expulsion depending on severity
  • The Safeguarding Officer (Responsabile Safeguarding) is the reference point for any concerns about wellbeing and safety
Safety and Liability
  • Participation in sports activities involves inherent risks accepted by the member
  • Members must have a valid medical certificate for sports practice (certificato medico sportivo)
  • Members must immediately report injuries or incidents to coaches, staff, or the Safeguarding Officer
  • Members must follow all safety protocols and use protective equipment when required
  • Parents/guardians are responsible for minors' attendance, pickup, and fulfilling all obligations toward the association (Art. 5.10 Statuto)
Fees and Payments (Art. 5.9, 6.5 Statuto)
  • Membership fees are established annually by the Board of Directors (Art. 17.d Statuto)
  • Additional fees may apply for competitions, events, uniforms, and special programs
  • Members who fail to pay fees within the deadline set by the Board automatically lose membership status (Art. 7.3 Statuto)
  • Membership fees are personal, non-transferable, non-refundable, and not revalued to members (Art. 5.9 Statuto)
  • Loss of membership for any reason does not entitle the member to refund of fees paid (Art. 7.6 Statuto)
Prohibited Activities

The following activities are strictly prohibited and may result in immediate suspension or termination of membership:

  • Using association facilities for unauthorized purposes
  • Bringing unauthorized persons to training sessions without permission
  • Consuming alcohol or illegal substances during association activities
  • Recording or photographing without permission
  • Engaging in any behavior that harms the reputation of the association
  • Violating any Italian laws or regulations
Membership Loss and Withdrawal (Art. 7 Statuto)

Withdrawal (Recesso)

  • • Members may withdraw at any time by notifying the Board of Directors; withdrawal is effective 30 days after receipt of notification (Art. 7.2)
  • • Membership fees are non-refundable upon withdrawal (Art. 5.9, 7.6 Statuto)
  • • Membership is lost through withdrawal, exclusion, or death (Art. 7.1)

Exclusion (Esclusione)

  • • For serious violations, members may be excluded by motivated resolution of the Board of Directors (Art. 7.4)
  • • The interested party may appeal to the Assembly within 30 days of receiving the exclusion notice (Art. 7.4)
  • • Exclusion is suspended pending Assembly decision and becomes effective upon annotation in the member registry (Art. 7.5)
Intellectual Property

All content on our website and materials, including text, graphics, logos, images, and videos, is the property of A.S.D. Majorettes Onda Azzurra and is protected by copyright and intellectual property laws.

  • You may not reproduce, distribute, or modify our content without written permission
  • Our name and logo are protected trademarks
  • Training materials and choreographies are proprietary
Limitation of Liability

IMPORTANT DISCLAIMER: A.S.D. Majorettes Onda Azzurra, its officers, directors, volunteers, and coaches shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from:

  • Personal injury during sports activities (within the limits of law)
  • Loss or theft of personal belongings
  • Interruption or cancellation of services due to circumstances beyond our control

All members are covered by the mandatory sports insurance as required by law. Additional personal insurance coverage is recommended.

Governing Law and Sports Justice (Art. 26 Statuto)

These Terms are governed by Italian law, D.Lgs. 36/2021 (Sports Reform), and the Italian Civil Code. Any sports-related disputes are devolved exclusively to the competent bodies of FITw, CONI, and affiliated Sports Promotion Bodies (Art. 26 Statuto). For other matters, the Court of Venice has jurisdiction.

These Terms, together with our Statuto, Codice di Condotta, and regulations of FITw and CONI, constitute the entire agreement. For matters not expressly covered, the provisions of the Italian Civil Code and applicable sector regulations apply (Art. 28 Statuto).

Dispute Resolution

We encourage the amicable resolution of any disputes. If you have concerns, please contact us first to try to resolve the matter. If necessary, disputes will be resolved according to Italian law and the applicable sports justice system.
